What to know before you sign a lease

Tenant protections vary enormously by state and city. These are the universals worth checking everywhere.

Read the full lease, including addenda

Late-fee amounts, renewal terms, early-termination penalties and maintenance responsibility are all in the addenda most renters skip. Get every promise in writing before signing.

Know your security deposit limits

Many states cap deposits at one or two months' rent and set a deadline for returning them after move-out, commonly 14 to 30 days. Document the unit's condition with dated photos on day one.

Fair Housing applies to rentals

Landlords cannot refuse to rent based on race, color, religion, sex, national origin, familial status or disability, and many states add further protected classes such as source of income.

Reasonable accommodations are a right

Tenants with disabilities may request reasonable accommodations and modifications. Landlords must engage with the request and cannot charge a fee simply for making one.

Budget the full monthly cost

Add renters insurance, utilities not covered by the landlord, parking, pet rent and amenity fees. The advertised rent is rarely the total.

Understand roommate liability

On a joint lease every tenant is usually liable for the entire rent, not just their share. If a roommate leaves, the remaining tenants typically owe the balance.
